OFFICIAL RULES:
1. Eligibility: To be eligible for this Hangout Industries, Inc. (“Hangout”) contest, you must (a) be a current member of the Superstar City application (“Superstar City”) in good standing, (b) have used virtual Star Cash (purchase optional) to buy the Featured Song “Summer Love” in the Superstar City Shop, (c) have opted-in to the contest by submitting your personal email address no later than 2 pm PST on Friday, July 23rd, 2010, and (d) be 13 years of age and older and a legal resident of the United States for the duration of the contest. Minors between the ages of 13 and 17 must first obtain the consent of their parent or legal guardian in order to enter. If the prize is won by a minor, it will be awarded to a parent or legal guardian on the minors’ behalf. There is a limit of one entry per avatar. Duplicate entries will be void. Full-time Hangout employees and members of their immediate families are not eligible for this contest. Hangout may reject any submitted entries that it determines, in its sole and absolute discretion, fail to meet any of these eligibility requirements. To be eligible you must agree to abide by these terms and conditions and be bound by all Hangout decisions relating to this contest, which are final and binding in all respects, including but not limited to Hangout’s determination of the winners.
2. Duration: The contest begins on Saturday, July 17th, 2010 at 10 am PST and ends on Friday, July 23rd at 2 pm PST.
3. Selection: A random drawing will take place on July 23rd after the entry deadline ends. The number of eligible entrants will determine odds of winning. In the event of a dispute regarding the identity of the person submitting the entry, the entry will be deemed to be submitted by the person in whose name the email account is registered. All drawings will be conducted under the supervision of Hangout. The decisions of Hangout are final and binding in all matters relating to this sweepstakes. Winner will be notified by email, as determined by Hangout. Winner must claim prize within five (5) business days after the date of notification of such prize and may be required to complete and submit the Affidavit of Eligibility provided by Hangout. Failure to respond to the prize notification within five (5) business days and/or submit, if applicable, the Affidavit of Eligibility will be considered winner’s forfeiture of the prize, and an alternate winner may be selected from the pool of eligible entries. The winner must provide a valid Superstar City user ID and user name in order to receive a prize. If a winner is found to be ineligible, an alternate winner may also be selected from the pool of eligible entries. All entries become the property of Hangout, and will not be returned. Winners agree to be bound by these Official Rules.
4. Prize: The winner of the contest will receive 2 Warped Tour tickets and a meet and greet with the band “We The Kings.” The tour dates are available in the cities where the Warped Tour is playing and the band “We The Kings” is on the playbill (http://www.wethekingsmusic.com/tourdates). Prizes are not exchangeable, transferable or redeemable for cash. In the event of unavailability of stated prizes, Hangout reserves the right to substitute a prize of comparable value. Entrants should be aware that certain tour dates occur very soon after the end of the contest and if the winner desires to go to the Warped Tour on one of those dates the winner must claim the prize and, if applicable, submit the Affidavit of Eligibility before it can receive the prize. The prize may be available at the venues hosting the Warped Tour.
5. Restrictions: This contest is void where prohibited or restricted by any relevant federal, state or local law, including but not limited to jurisdictions with laws that would require registration, disclosure, filing, trust account or posting of a bond, or any other requirements that are not satisfied.
6. Limitation on Liability: Notwithstanding anything to the contrary, neither Hangout, nor any supplier, employee, director or agent shall be liable under any legal or equitable theory for, and you further agree to release, defend and hold Hangout, its suppliers, employees, directors or agents harmless from, any and all claims, injuries, damages, expenses or losses to person or property and/or liabilities of any nature that arise from participation in this contest or acceptance or use of a prize, including without limitation (a) any technical or human error which may occur in the process of submitting your entry that may limit your ability to participate in this contest, (b) failure of your entry submission to be included in the contest, (c) your use, or inability to use, the prize, or (d) any injuries, losses or damages caused by a prize awarded (or failed to be awarded) in the contest or participation in the contest.
7. Warranty Disclaimer: The prize is provided on an AS IS basis, and Hangout disclaims all warranties, whether express or implied, with respect thereto or to any other subject matter of these terms and conditions.
8. Release and Publicity: You hereby forever release and grant Hangout the right to use and disclose your name and your entry in connection with Superstar City, the Hangout website, blog or any Hangout promotion of the contest results or related publicity, including, without limitation, a press release. You hereby acknowledge and agree that Hangout is hereby granted a non-exclusive, worldwide, royalty-free, transferable right to display, perform, use, reproduce, modify, distribute and provide users access to all entries (including all related intellectual property rights) in connection with Superstar City and Hangout services and website.
9. Assignment: The prize is not assignable or transferable by you without written consent from Hangout. Hangout may freely assign and delegate its obligations hereunder.
10. Other Terms: Hangout is the sponsor of this contest. This contest is governed by and shall be construed under the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict of laws provisions. The parties hereby irrevocably consent to exclusive jurisdiction and venue in the state and federal courts of Boston, Massachusetts. If any provision of these terms and conditions is held to be illegal or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that these rules shall otherwise remain in full force and effect and enforceable to the fullest extent permitted by applicable law. Hangout reserves the right, at its sole discretion, to disqualify any individual found tampering or otherwise interfering with the contest. If Hangout determines, in its sole discretion, that the contest is compromised by any corruption of the administration, security, or proper play of this contest then, at Hangout’s sole discretion, it may cancel the contest. The winners will be subject to, and responsible for, all applicable U.S. taxes and withholding.
